 Pennsylvania Legislature Proposes Property Tax Relief for Seniors

Senate Bill 645 has been proposed in the legislature to prevent local municipalities from increasing property taxes on Seniors.  If passed in its current form, the new law would exempt those over 65, who have lived in their property for five years, and who have earned under $65,000.00 from any new increases in property tax for one property owned by such person. Howard Soffer successfully presented the concerns of the Lin-Park Civic Association over a proposed Townhouse Development in Bensalem Township. On March 16th, the Bensalem Township Planning Commission unanimously rejected the developer’s proposal.  To learn more, click on

Holly Soffer Appears Before Heated Meeting of Hulmeville Borough Zoning Board On Behalf of Neshaminy Shore Picnic Park

In a lively meeting that lasted until almost midnight, the Hulmeville Borough Zoning Board heard testimony on whether Neshaminy Shore Picnic Park should be able to continue to operate its business as a picnic park with the sound of music and games exceeding the levels of a Hulmeville Borough noise ordinance, since the park has been operating as a picnic park with music long before the Ordinance was enacted.  Development around the park has removed some of the natural buffers, and homes have been built in close proximity to the park, worsening the level of sound escaping the park.  Holly made legal argument to the Board that the park’s business was “grandfathered” as a non-conforming use, and presented the testimony of former park owner Norman Shore, current owner Curtis Dawson, and entertainment director Ronald Sherr.  Many neighbors also testified both for and against the Park’s application for relief, including local business owners supporting their “good neighbor”   Neshaminy Shore Picnic Park.  After briefs from the parties, the Board will be voting on the issue at their next meeting on April 20th.

 

Limitation of liability for mold and mold damage

A new law proposed in Pennsylvania will limit liability for contractors who install an HVAC system  in so that they are not liable for personal injuries, property damage, or other losses related to mold damage, unless such damage is caused by a defect in workmanship caused by the contractor installing the HVAC system.  Litigation over mold damage to homes is burgeoning in Pennsylvania, and this is an attempt by the legislature to set some limits on the responsibility of the various parties involved.  As a business owner, if you do install HVAC systems, you will want to follow this Bill.  You should also make sure that your contract with the homeowner reflects the current law in other areas, too.
